Johnson Utilities Hearing Postponed until April 16, 2018

The first day of the administrative law judge hearing regarding billing and water quality issues with Johnson Utilities was to begin today at 10 a.m however after the Corporation Commission opened the open meeting, they went into Executive Session until about 11:15 a.m.  After returning from executive session, a motion to postpone the hearing until April 16, 2018 was introduced and approved 5-0.

On February 23, 2018, after two days of hearings in San Tan Valley, the Arizona Corporation Commission (ACC) opened a docket and requested an emergency investigation into water quality, air quality and billing issues of Johnson Utilities.  Results of the emergency investigation were to be reported to the ACC before the March 13th ACC Open Meeting, so that the Commissioners could vote on the possibility of appointing an interim manager to manage Johnson Utilities.

ACC Approves Request to Reduce Johnson Utilities CAGRD Fees

At its February 6, 2018 Open Meeting, the Arizona Corporation Commission approved Johnson Utilities’ request to reduce its CAGRD Adjustor Fees. The CAGRD Adjustor Fee is reset annually and is included as a line item on its customers’ monthly water bills. The recently reduced fees are now $2.35 per 1,000 gallons consumed in the Phoenix Active Management Area (“AMA”) (San Tan Valley residents north of Arizona Farms) and $1.91 per 1,000 gallons consumed in the Pinal AMA (San Tan Valley & Florence residents south of Arizona Farms).

A subpoena has been issued to the Arizona Corporation Commission for records in conjunction with a criminal investigation of George Johnson, owner of Johnson Utilities, and Gary Pierce, a former ACC commissioner. In the criminal investigation, an ACC ruling allowing George Johnson to include his personal income taxes as utility expenses included in rates is alleged to be the result of bribes from Mr. Johnson. The defendants have entered not guilty pleas and Johnson Utilities said the records under subpoena are irrelevant to the investigation.

Johnson Utilities Bills Could Decrease

Johnson Utilities has submitted a plan to reduce their Central Arizona Groundwater Replenishment District (CAGRD) fee from $4.19 to $2.35 per thousand gallons of water delivered in the Phoenix Active Management Areas (AMA).  If approved by the Arizona Corporation Commission, San Tan Valley residents could see a significant reduction in their water bills.
