Hearing to Decide if Johnson Utilities and It's Managers Should be Held in Contempt Set for August 24

During the Open Meeting held Tuesday, August 14, 2018, at the Arizona Corporation Commission, the Commissioners asked for a procedural hearing allowing an Administrative Law Judge to decide if Johnson Utilities and its managers could be held in contempt of court.  The request was made after Epcor, who had been appointed as an Interim Manager on July 26, 2018, reported that they still had not been granted access to Johnson Utilities' financial systems or accounts.

In a letter written to his Corporation Commission colleagues August 21, 2018, Commissioner Andy Tobin called for an emergency meeting to authorize issuing a search and seizure warrant on Johnson Utilities, LLC. The plea follows weeks of legal wrangling by the utility to avoid complying with a Corporation Commission order appointing EPCOR as an interim manager to run the company.

Pinal County Superior Court Judge Stephen McCarville set an August 30, 2018 2:00 p.m. deadline for Johnson Utilities to provide EPCOR with full and exclusive access to and control over all revenues paid by customers & associated list of financial institutions as well as exclusive access to facilities, records, accounts, and materials owned by Johnson Utilities. At 10:00 a.m. July 24, 2018, the Arizona Corporation Commission opened a Special Open Meeting for Docket #WS-02987A-18-0050, to either approve or reject the Administrative Law Judge's Recommended Order and Opinion to appoint an interim manager for Johnson Utilities. About an hour later, with a vote of 4-0, Chairman Forese and Commissioners Dunn, Olson and Burns voted to approve the recommendation to appoint an interim manager.
