Letter to the Editor: Truth Telling

letter-to-editor-stv

Mr. Chairman, today the Board has a teaching opportunity on truth telling in Pinal classrooms and in this Board of Supervisors.

This past month you addressed County Attorney Miller's unlawful 287(g) ICE agreement. Decisive actions that have hopefully saved taxpayers from costly expenses while also emphasizing the value of truth-telling.

However, you have not addressed the recently signed, but flawed, Intergovernmental Agreement with the Florence Unified School District for School Resource Officer Services. An Agreement flawed by untruthful and misleading comments, to both this Board and to the public, by Florence School Board president Roger Biede.

During discussion of the Agreement, I asked questions about the protocol for resolving conflicts facing School Resource Officers whose responsibility per the Agreement, is "the safety and security of pupils, teachers, administrators or other occupants of the school". A conflict already occurring on Pinal County school campuses where fear, safety and security are being fueled by scenes of violent ICE agents and militarized law enforcement.

Mr. Biede boldly replied that the issues I raised had been, in his words, "much discussed" by the Florence School Board when they approved the county agreement.

No, the School Board did not and could not have discussed, in July, specific issues that were first raised four months later at this Board of Supervisors meeting in November.

Moreover, Mr. Biede's arrogant untruthfulness is laid bare by the undisputed fact that his school board approved the Agreement under a consent agenda โ€“ without discussion.

If intergovernmental agreements are to be respected, they must be based on truth.

In contract law, Arizona Statute 44, section 1797.13 states that if an agreement is entered into based on untrue, misleading information, or material omissions, the agreement may be voided.

I ask you to apply this state law and void the Florence School Board agreement until these conflicting issues can be truthfully discussed and resolved. To leave these conflicts unresolved is a disservice to our County's Resource Officers and most critically fails to focus on the safety and security of pupils, teachers, administrators or other occupants of Pinal County schools.

Mr Chairman, Truthfulness must govern in our classrooms, school boards and the Board of Supervisors.

Please direct staff to study the flawed school board agreement and reschedule it for further consideration and informed decision.
