Horne: Bulk of State's $57 Million in Historic Mortgage Settlement to Keep People in Homes

by: Attorney General Tom Horne

Attorney General Tom Horne today released the details explaining how Arizona will utilize $57 million in Mortgage Settlement funds. This $57 million is comprised of funds awarded to Arizona as part of the National Mortgage Settlement with the five largest banks plus $10 million obtained by the Attorney General to settle a separate lawsuit against Bank of America.

“I am committed to making sure every Arizonan who is eligible for National Mortgage Settlement assistance gets it,” Horne said. “Approximately $41 million, which comes from a combination of a portion of the National Settlement and Arizona’s unique settlement with Bank of America, will be used to help keep people in their homes and for consumer restitution. There will also be funding for enforcement so as to ensure that the terms of the settlement are adhered to, as well as money for housing counseling, legal assistance and a communications plan designed to let eligible borrowers know what programs are available.”

A detailed breakdown of the use of the funds can be found here (pdf).

The Attorney General serves as the chief legal officer of the State. The Attorney General is mandated by our constitution and elected to a four-year term by the people of Arizona.

The Attorney General’s Office represents and provides legal advice to most State agencies; enforces consumer protection and civil rights laws; and prosecutes criminals charged with complex financial crimes and certain conspiracies involving illegal drugs. In addition, all appeals statewide from felony convictions are handled by this Office.

The Child and Family Protection Division provides legal services to the Department of Economic Security (DES), including Child Protective Services (CPS) and Child Support Enforcement.

The Attorney General’s Office brings and defends lawsuits on behalf of the State and prepares formal legal opinions requested by State officers, legislators, or county attorneys on issues of law.

The Attorney General’s Office has jurisdiction over Arizona's Consumer Fraud Act, white collar crime, organized crime, public corruption, environmental laws, civil rights laws, and crimes committed in more than one county. Additionally, this Office prosecutes cases normally handled by county attorneys when they have a conflict.
